"This website" refers to Budget Accommodation Guide, www.budgetaccommodationguide.com. "The booking engines" refer to HostelBookers and BookHostels. "You" refers to user or users of the accommodation booking facility provided by this website, which includes links to the booking engines and additional details. "The accommodation" refers to the hotel, hostel, guesthouses, inns, and other accommodation providers.
Bookings made on this website is provided by two major accommodation booking engines, HostelBookers and BookHostels. This website and the booking engines confirm bookings to individual accommodations, though we do not operate any of the properties ourselves. We recommend that you reconfirm your booking with the property prior to arrival.
Upon confirming a reservation, you agree to pay a non-refundable and non transferable deposit of 10% of the total value of your booking, in addition to any booking fees in effect at the time of booking. You will be responsible to the accommodation provider for payment of the balance of the accommodation cost per person.
Any cancellations must be made directly with the accommodation, at least 48 hours before your due arrival date (unless otherwise stated in the booking). Failure to cancel your booking will result in the accommodation charging your credit / debit card for the first night’s stay. Should a member of your party not travel, the “non refundable” deposit paid by that person is not transferable to another member of your party.
Deposits are non refundable & non transferrable in the event of you canceling or amending a booking.
Every effort is made to ensure that the accommodation processes your booking correctly, though in the unlikely event of a problem arising, the liability of the booking engines is limited to the deposit paid only. This website is not liable to any problems arising and will refer your issue to the booking engines. It is the sole responsibility of the accommodation to provide you with the accommodation and/or other services reserved. We recommend that you reconfirm your booking prior to arrival to avoid complications, which also assists the property in preparing for your arrival, i.e. check-in times.
Customer ratings & reviews shown on the booking engine are the aggregated opinions of customers who have booked through Hostelbookers (not available with BookHostels), stayed at the accommodation and completed and returned a feedback form to Hostelbookers upon their departure.
THE LEGAL STUFF
The legal stuff below pertains to bookings made using the Hostelbookers booking engine, which resides within this website. The use of "we / us / our" from here onwards refers to Hostelbookers and not Budget Accommodation Guide.
This agreement is between you the user of this site (“you”) and Hostelbookers (“we / us / our / the booking engine”). Your use of the booking engine is conditional upon your irrevocable acceptance without modification of the terms, conditions and notices contained herein and your agreement to use the booking engine in accordance with and subject to these terms, conditions and notices. The terms, conditions and notices as set out hereunder constitute the entire agreement between you the user of this site, and Hostelbookers.
Hostelbooker's liability
Hostelbookers endeavors to check the accuracy of information published on the booking engine with the accommodation providers. You should note however that we do not warrant that such information will be error free and in using the booking engine you acknowledge that the information provided may include inaccuracies and / or typographical errors.
Hostelbookers acts as a booking engine and intermediary for the accommodation provider concerned. We are not a party to the agreement between you and the accommodation provider and have no responsibility or liability to you in respect of the terms of that contract.
We recommend that you ensure that the accommodation provider's terms and conditions of trade are to your satisfaction because Hostelbookers does not warrant their contents.
Hostelbookers is not in any way liable in respect of any damage or loss suffered by you or any 3rd party arising from or in any way connected with the use of the booking engine.
While we make every reasonable effort to ensure that the accommodation listed is of an acceptable standard, the listing of any accommodation premises on this site is not and should not be taken to be a recommendation from Hostelbookers, or a representation that the premises will be suitable for the users purpose.
Hostelbookers shall not be liable to you in the event that the accommodation is not suitable for your purpose.
Confirming a reservation
Upon confirming a reservation, you agree to pay a non-refundable deposit of 10% of the total value of your booking in addition to any booking fees in effect at the time of booking. You will be responsible to the accommodation provider for payment of the balance of the accommodation cost together with the payment of charges for any additional services subsequently contracted for with the provider and, where applicable, payment of the provider's service charges and taxes specified in the terms and conditions of trade applied by the accommodation provider.
You must use a credit or debit card to confirm a reservation. By making a reservation with your credit / debit card you authorise the accommodation provider to charge one night’s room charge to your card without further reference to you, in the event that you cancel your reservation less than 48 hours (unless otherwise stated in the booking) from your agreed check- in time or in the event that you fail to arrive. Non-arrival will result in the cancellation of your entire reservation. Any changes to your reservation must be notified to and agreed with the accommodation provider directly, and are at the discretion of the accommodation provider.
Upon confirming a reservation, it is your responsibility to disclose to the accommodation provider any physical, mental or other condition to which you or any other member of your party is subject to, which may require the accommodation provider to make special provisions or facilities available. Any such provisions or facilities are made at the accommodation provider’s discretion.
Once a reservation is confirmed
Hostelbookers will issue the booking form on behalf of the service provider for each reservation, but does not undertake to include charges for additional services or details of the service charges or taxes of the accommodation provider.
We suggest that you check and confirm with the accommodation provider the precise terms and conditions upon which they make the reserved service available to you. The reservation numbers included on your booking confirmation should be quoted to the accommodation provider in all enquiries, cancellations or amendments to the reservation.
Cancellations & amendments to bookings
Hostelbookers do not accept responsibility for cancellations or amendments to bookings under any circumstances. We do not accept any liability for losses, additional expenses you incur, or any claim whatsoever, due to changes in the accommodation provided, sickness, adverse weather conditions, strikes, Acts of God, or for any other reason. All such liability rests with the person who has booked the accommodation.
Credit / Debit card transactions
Hostelbookers makes all reasonable efforts to ensure that card transactions are secure. However, if unauthorised charges appear on the credit /debit card (statement) you have used on Hostelbookers at any time during or after you have made your reservation, conducted your transaction, or disclosed your credit / debit card details on the booking engine, Hostelbookers shall not be liable or responsible in any way in respect of any damage or loss of whatever nature, suffered by you arising from or in any way connected with the use, transaction or disclosure of the card details.
Binding obligations and prohibited use
You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You understand that you are financially responsible for all uses of this site by you and those using your login information. As a condition of your use of the booking engine, you undertake to Hostelbookers that you will not use the booking engine for any purpose that is unlawful or prohibited by these terms, conditions and notices.
Links To 3rd party web sites
The booking engine contains hyperlinks to web sites operated by parties other than Hostelbookers. Such hyperlinks are provided for your reference only. We do not control such web sites and are not responsible for their content. Our inclusion of hyperlinks to any 3rd party web sites does not imply any endorsement of the content on such web sites, or any association with them.
Waiver
Our failure to enforce at any time or for any period any one or more of the terms and conditions of this Agreement shall not be a waiver of the rights attached to any of them.
Hostelbookers reserves the right to change the terms and conditions under which the booking engine is offered without notice. This right shall not affect the existing terms and conditions accepted by you upon making a legitimate reservation or purchase using the booking engine.
Headings
The headings used in this Agreement are for convenience purposes only and shall not affect the meaning or scope of this Agreement or be given other legal effect.
Copyright
The contents of the booking engine are protected by copyright. You may not copy, distribute, transmit, display, reproduce, publish, license, transfer, or sell any information, software, products or services obtained from the booking engine. Breach of any of the terms of use of the booking engine will result in prosecution.
General
The laws of the United Kingdom govern this agreement. You hereby consent to the exclusive jurisdiction of the United Kingdom courts in resolving all disputes arising out of or relating to the use of the booking engine. Use of the booking engine is unauthorised in any jurisdiction that does not give effect to all the provisions of these terms and conditions, including this paragraph.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement, to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Hostelbookers as a result of this agreement or use of the booking engine. Our performance of this agreement is subject to the existing laws and legal process of the United Kingdom and nothing contained in this agreement prohibits our right to comply with law enforcement requests or requirements relating to your use of the booking engine, or to provide information gathered by Hostelbookers with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent and spirit of the original provision, and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between you and Hostelbookers and it supersedes all prior or contemporaneous communications (whether electronic, oral or written) between you and us with respect to transactions facilitated by the booking engine.
